General Terms and Conditions AlpenLuxus Appartements

Scope of application

 

  1. These General Terms and Conditions for the Hotel Industry (hereinafter referred to as “AGBH 2006”) shall apply to all accommodation contracts concluded between the accommodation provider (hereinafter also referred to as “AlpenLuxus Appartements”) and the guest or contractual partner (hereinafter also referred to as “customer”).
    The AGBH 2006 do not exclude special agreements. The AGBH 2006 are subsidiary to individual agreements.


  2. Definitions of terms
    Definitions of terms:

  3. “Proprietor": Is a natural or legal person who accommodates guests in return for payment.
    “Guest": Is a natural person who makes use of accommodation. The guest is usually also the contractual partner. Guests also include those persons traveling with the contracting party (e.g. family members, friends, etc.).


  4. “Party": a natural or legal person in Austria or abroad who concludes an accommodation contract as a guest or on behalf of a guest.
    “Consumer” and ‘Entrepreneur’: The terms are to be understood in the sense of the 1979 Consumer Protection Act as amended.
    “Accommodation contract": Is the contract concluded between the accommodation provider and the contracting party, the content of which is regulated in more detail below.


  5. Conclusion of contract, special provisions for the conclusion of distance contracts, down payment


  6. The Accommodation Agreement shall be concluded upon acceptance of the Party's order by the Proprietor. Electronic declarations shall be deemed to have been received if the party for whom they are intended can retrieve them under normal circumstances and if they are received during the published business hours of the accommodation provider.
    The basis for the fee shall be the prices stated in the current price list of the accommodation provider at the time of conclusion of the contract, as well as prices agreed individually by special agreement.
    Acceptance by the Proprietor in the case of bookings made by means of distance communication shall be effected exclusively by means of a reservation confirmation by the Proprietor by e-mail.
    In case of doubt, verbal communications by the Proprietor - even at the request of the Guest - shall be non-binding and shall serve to prepare the conclusion of the contract even if prices, periods or other specifications are communicated therein.

  1. In the case of online bookings, a reservation can only be made after all mandatory fields in the reservation window have been entered completely and correctly and the AGBH 2006 have been expressly acknowledged using the application provided in the reservation window.
    The contractual partner is solely responsible for the correct entry/provision of the data. If the reservation process was only incorrect due to incorrect or incomplete data being entered/notified, the booking can either be corrected with the help of the innkeeper or another reservation confirmation can be issued. In all cases of complaint, the contractual partner must in any case present the reservation confirmation, as otherwise the hospitality can be refused by the innkeeper. The electronic reservation confirmation of the innkeeper serves as the only admissible proof of a properly made reservation and must therefore be carried by the contractual partner and presented to the innkeeper's staff in the event of complaints.
    In the course of the reservation process, the full booking amount is due without delay (immediately).

  2. The Proprietor shall be entitled to conclude the Accommodation Agreement by individual agreement with the Party with a partial payment option for the full booking amount.
    The Party acknowledges that the reservation process for online reservations can no longer be canceled or reversed once the “Book now for a fee!” button has been clicked.


  3. Start and end of accommodation


  4. Unless the Proprietor offers a different time of occupancy, the Party shall have the right to occupy the rented rooms from 3 p.m. on the agreed day (“day of arrival”).
    The rented rooms shall be vacated by the Party by 10.00 a.m. on the day of departure. The Proprietor shall be entitled to charge an additional day if the rented rooms are not vacated in due time.

Key


 The customer(s) must be given custody of the key to the rental property on the day of arrival.
If a key is lost, this must be reported immediately. The costs for the necessary replacement of the locking system shall be borne by the customer.


Withdrawal from the accommodation contract - cancellation fee, hindrance to arrival

Withdrawal by the accommodation provider

If the payment stipulated in the Accommodation Agreement is not made by the Party without delay (immediately) in the course of the booking process, the Proprietor may rescind the Accommodation Agreement without granting a grace period.

 


Withdrawal by the contracting party - change of date or voucher

  1. Der Vertragspartner nimmt zur Kenntnis, dass der Reservierungsvorgang bei Onlinereservierungen nach Betätigung des Buttons „Jetzt kostenpflichtig buchen!“ nicht mehr storniert oder rückgängig gemacht werden kann.

  2. Bei der durch den Beherberger erbrachten Leistung handelt es sich um eine Dienstleistung, die zu einer im Vorhinein eingegrenzten Zeit erfolgen sollen. Dem Vertragspartner steht demnach kein Rücktrittsrecht gemäß § 11 Abs 1 FAGG zu. Der Vertragsabschluss bringt die Bereitstellung von Kapazitäten mit sich, die der Beherberger im Fall der Ausübung eines Widerrufsrechts möglicherweise nicht mehr anderweitig nutzen könnte. Die Einräumung eines Widerrufsrechts ist damit unangebracht.

  3. Der Beherberger ist berechtigt, dem Vertragspartner – nach einer entsprechenden Anfrage – eine Datumsänderung für die getätigte Buchung zu ermöglichen. Sollte dadurch eine Änderung des vereinbarten Buchungsentgelts unvermeidbar werden, geht diese Änderung zu Gunsten und zu Lasten des Vertragspartners.

  4. Alternativ zu einer Datumsänderung ist der Beherberger berechtigt, dem Vertragspartner– nach einer entsprechenden Anfrage – einen Gutschein im Wert des Buchungsbetrages auszustellen, der vom Vertragspartner in allen AlpenLuxus Appartements in Österreich eingelöst werden kann.

 

 

Behinderungen der Anreise

  1. Kann der Vertragspartner am Tag der Anreise nicht in der Unterkunft erscheinen, weil durch unvorhersehbare außergewöhnliche Umstände (zB extremer Schneefall, Hochwasser etc) sämtliche Anreisemöglichkeiten unmöglich sind, ist der Vertragspartner nicht verpflichtet, das vereinbarte Entgelt für die Tage der Anreise zu bezahlen.

  2. Die Entgeltzahlungspflicht für den gebuchten Aufenthalt lebt ab Anreisemöglichkeit wieder auf, wenn die Anreise innerhalb von drei Tagen wieder möglich wird.

 

 

Beistellung einer Ersatzunterkunft

 

  1. Der Beherberger kann dem Vertragspartner bzw den Gästen eine adäquate Er- satzunterkunft (gleicher Qualität) zur Verfügung stellen, wenn dies dem Vertragspartner zumutbar ist, besonders wenn die Abweichung geringfügig und sachlich gerechtfertigt ist.

  2. Eine sachliche Rechtfertigung ist beispielsweise dann gegeben, wenn der Raum (die Räume) unbenutzbar geworden ist (sind), bereits einquartierte Gäste ihren Aufenthalt verlängern, eine Überbuchung vorliegt oder sonstige wichtige betriebliche Maßnahmen diesen Schritt bedingen.

  3. Allfällige Mehraufwendungen für das Ersatzquartier gehen auf Kosten des Beherbergers.

 

 

Rechte des Vertragspartners

 

  1. 7.1 Durch den Abschluss eines Beherbergungsvertrages erwirbt der Vertragspartner das Recht auf den üblichen Gebrauch der gemieteten Räume. Der Vertragspartner hat seine Rechte gemäß der Hausordnung auszuüben. Die Hausordnung ist für den Gast sowohl vor Ort in den gemieteten Räumen als auch vorab in der vom Beherberger übersendeten Online-Gästemappe erischtlich.

 

 

Pflichten des Vertragspartners

 

  1. Der Vertragspartner ist verpflichtet, das vereinbarte Entgelt zuzüglich gesetzlicher Umsatzsteuer zu bezahlen. Die Bezahlung hat ohne Aufschub (sofort) im Zuge des Onlinebuchungsvorganges zu erfolgen.

  2. Der Vertragspartner haftet dem Beherberger gegenüber für jeden Schaden, den er oder der Gast oder sonstige Personen, die mit Wissen oder Willen des Vertragspartners Leistungen des Beherbergers entgegennehmen, verursachen. Für Ansprüche Dritter hält der Vertragspartner/Gast den Beherberger zur Gänze schad- und klaglos.

 

 

Rechte des Beherbergers

 

  1. Der Beherberger ist nicht verpflichtet, Fremdwährungen zu akzeptieren.

 

 

Pflichten des Beherbergers

 

  1. Der Beherberger ist verpflichtet, die vereinbarten Leistungen in einem seinem Standard entsprechenden Umfang zu erbringen.

 

 

Liability limitations




If the contracting party is a consumer, the liability of the accommodation provider – also for items brought in – is excluded for slight negligence, with the exception of personal injury.If the contracting party is a businessman, the liability of the accommodation provider for slight and gross negligence is excluded. In this case, the contracting party bears the burden of proof for the existence of fault. Consequential damages, intangible damages, or indirect damages as well as lost profits will not be compensated. The damage to be compensated is, in any case, limited to the amount of the reliance interest.
No liability is accepted for lost items of the guest/contract partner.
The innkeeper strives to promptly resolve any disturbances related to technical facilities and other amenities provided directly by the innkeeper. The innkeeper is not liable for failures of these facilities, as well as the power grid or other infrastructural facilities.
Liability is excluded in any case if the contracting partner and/or guest does not promptly notify the innkeeper of the damage incurred upon becoming aware of it. Moreover, these claims must be asserted in court within three years from the knowledge or possible knowledge of the contracting partner or guest. otherwise the right is extinguished.




Animal husbandry




Animals may only be brought into the booked premises with the prior consent of the accommodation provider and possibly against a special fee.
The contracting party that brings an animal is obligated to properly care for or supervise this animal during its stay, or to have it cared for or supervised at their own expense by suitable third parties.
The contracting party or guest who brings an animal must have appropriate animal liability insurance or private liability insurance that also covers potential damages caused by the animal. The proof of the corresponding insurance must be provided upon request by the accommodation provider.
The contracting party or their insurer is jointly liable to the accommodation provider for any damage caused by animals brought along. The damage also specifically includes those compensation payments that the accommodation provider is required to make to third parties.




Extension of accommodation




The contracting party has no right to have their stay extended. If the contracting party announces their wish to extend their stay in a timely manner, the accommodation provider may agree to the extension of the accommodation contract. The host has no obligation in this regard.
If the contracting party cannot leave the accommodation on the day of departure due to unforeseeable extraordinary circumstances (e.g., extreme snowfall, flooding, etc.) that render all departure options blocked or unusable, the accommodation contract will be automatically extended for the duration of the impossibility of departure. A reduction of the fee for this period is only possible if the contracting party is unable to fully utilize the services offered by the accommodation provider due to the extraordinary weather conditions. The host is entitled to demand at least the fee that corresponds to the usual price charged in the off-season.




Termination of the accommodation contract – Early dissolution

 

  1. If the accommodation contract was concluded for a specific period, it ends with the expiration of that period.
    If the contracting party departs early, the accommodation provider is entitled to demand the full agreed payment. The provider will deduct what he has saved due to the non-utilization of his service offer or what he has earned through the alternative rental of the ordered rooms. A saving only exists if the accommodation establishment is fully booked at the time the guest does not make use of the reserved premises and the space can be rented out to other guests due to the cancellation by the contracting party. The burden of proof for the savings lies with the contracting party.
    The contract with the accommodation provider ends with the death of a guest.
    The accommodation provider is entitled to terminate the accommodation contract with immediate effect for good cause, particularly if the contracting party or the guest makes significantly detrimental use of the premises or, through their reckless, offensive, or otherwise grossly inappropriate behavior, makes cohabitation unpleasant for the other guests, the owner, their staff, or third parties residing in the accommodation building, or commits an act against property, morality, or physical safety that is punishable by law against these individuals.
    infected with a contagious disease or a disease that persists beyond the duration of accommodation, or otherwise becomes in need of care;
    If the fulfillment of the contract becomes impossible due to an event considered as force majeure (e.g., natural disasters, strikes, lockouts, official orders, etc.), the accommodation provider can terminate the accommodation contract at any time without observing a notice period, provided that the contract is not already deemed terminated by law, or the accommodation provider is exempt from their obligation to provide accommodation. Any claims for damages, etc., by the contracting party are excluded.

 

Place of performance, place of jurisdiction and choice of law


The place of performance is the place where the accommodation facility is located.
This contract is subject to Austrian formal and substantive law, excluding the rules of international private law (in particular IPRG and EVÜ) and the UN Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction in the bilateral business transaction is the registered office of the accommodation provider, whereby the accommodation provider is also entitled to assert its rights at any other local and subject matter court.
If the accommodation contract was concluded with a contractual partner who is a consumer and has his place of residence or habitual residence in Austria, legal action against the consumer can only be brought at the consumer's place of residence, habitual residence or place of employment.
If the accommodation contract was concluded with a contractual partner who is a consumer and is domiciled in a member state of the European Union (with the exception of Austria), Iceland, Norway or Switzerland, the competent authority for legal action against the consumer at the consumer's place of residence is the competent authority Court has exclusive jurisdiction.

 


Miscellaneous

 

  1. Unless the above provisions provide for something special, the running of a deadline begins with delivery of the document setting the deadline to the contractual partner, who must comply with the deadline. When calculating a period that is determined in days, the day on which the time or event falls, according to which the start of the period is to be based, is not taken into account. Deadlines determined by weeks or months refer to the day of the week or month whose name or number corresponds to the day from which the deadline is to be counted. If this day is missing in the month, the last day of that month is decisive.
    Declarations must be received by the other contractual partner on the last day of the deadline (midnight).
    The accommodation provider is entitled to offset the contractual partner's claims with his own claims. The contractual partner is not entitled to offset its own claims against the accommodation provider's claims, unless the accommodation provider is insolvent or the contractual partner's claim has been determined by a court or recognized by the accommodation provider.
